1. Acceptance of These Terms
These Terms of Service form a binding agreement between you and ADAMS CANYON COTTAGE LLC, a company registered in the United States at 2989 Orson F Dr, Layton - 84040-7543, United States (US). The website and all related services are designed, developed and operated by the developer AdamsCottage. By accessing this website, sending us a message, making a booking or staying at the cottage, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use the website and do not make a booking.
These terms apply to all visitors, guests and users of our services, whether they book directly with us or through another channel. We encourage you to read these terms carefully before making a reservation and to keep a copy for your records. By booking with us, you also confirm that you have the authority to agree to these terms on behalf of any other person in your party, and that those people will follow the rules described here during their stay.
2. About ADAMS CANYON COTTAGE LLC
ADAMS CANYON COTTAGE LLC operates a small cottage retreat at the edge of the canyon in Layton, Utah, United States. The retreat offers five guest rooms, a shared kitchen, an outdoor firepit and access to nearby hiking trails. Our business address is 2989 Orson F Dr, Layton - 84040-7543, United States (US), and you can reach us by email at alert@adamscottage.lol or by phone at +18146214805.
The cottage is run as a family operation, and we personally look after every booking, every room and every guest. We keep our services simple and honest, and we aim to make each stay comfortable, clean and quiet. These terms describe the rules that apply when you use our website and stay with us. They do not affect any rights you have under the law, and where the law gives you stronger protection than these terms, the law will apply.
3. Use of the Website
By using this website you agree to do so lawfully and responsibly. You may browse our pages, read our content and use our contact form for legitimate purposes. You do not need to create an account to use the site, and we do not ask you to register before you can read about the cottage or send us a message. You must not use the website in any way that damages it, overloads it, interferes with other users or attempts to gain unauthorised access to any part of the site or to any system connected to it.
You must not introduce malicious software, attempt to probe or test the security of the site, or copy large portions of our content without our permission. We may suspend access to the website for anyone who uses it improperly. While we aim to keep the website available at all times, we do not guarantee that it will be uninterrupted or free from errors, and we may update or take down pages at any time without notice. If you notice a fault on the website, please tell us so that we can fix it.
4. Reservations and Bookings
Reservations at the cottage can be made by contacting us through the website, by email at alert@adamscottage.lol or by phone at +18146214805. When you request a booking, we will confirm availability and share the details of your stay, including the dates, the room, the rate and the house rules. A booking becomes final when we confirm it with you and, where required, when you pay a deposit or the full amount.
You must be at least eighteen years old to make a reservation, and you are responsible for the conduct of everyone in your party. For group bookings of two or more rooms, we may ask for a signed confirmation and a refundable security deposit. We accept bookings on a first come, first served basis, and we may decline a booking for any lawful reason. Please provide accurate information when booking, because your details are used to prepare your room and to keep in touch with you, and you will receive a confirmation by email once your dates are secured.
5. Payments and Deposits
Rates for stays are shown when you book or shared with you when you ask for availability. Unless we agree otherwise, payment is due according to the schedule confirmed at the time of booking. We accept payment by the methods listed on our site or shared in your confirmation, and all prices are in United States dollars unless we state otherwise. Any taxes and fees that apply will be shown on your confirmation before you pay.
Payment is processed by a secure third party provider, and we do not store your full card details on our systems. If a payment fails, we will contact you to arrange an alternative method. We reserve the right to cancel a booking if payment is not received by the due date, and we will always notify you before any booking is released. For long stays we may divide the total into monthly payments, and we will set out that schedule clearly before you confirm.
6. Cancellation and Refund Policy
We understand that plans change, and our cancellation terms depend on the type of booking and are confirmed at the time you reserve. In general, a cancellation made more than seven days before check-in is eligible for a full refund of any deposit paid. A cancellation made within seven days of check-in may forfeit a deposit or the first night, depending on our agreement. An early departure during a stay does not entitle you to a refund of unused nights unless we agree otherwise.
To cancel, contact us as soon as possible by email at alert@adamscottage.lol or by phone at +18146214805. If we cancel your booking for reasons beyond our control, such as serious damage to the property or a forced closure, we will refund any amounts you have paid in full. We also encourage guests to arrange travel insurance for long journeys, so that weather and travel disruptions do not cause you an unexpected loss.
7. Guest Conduct
All guests are expected to behave with respect for the cottage, the surrounding land and other guests. Quiet hours apply between ten in the evening and seven in the morning, so that everyone can rest. Guests must not disturb neighbours, hold loud parties or cause excessive noise at any time of day. The cottage is a non smoking property, and smoking is not permitted indoors or on the porch.
The number of guests must not exceed the number agreed at the time of booking, and no extra visitors may stay overnight without our permission. Guests are responsible for the behaviour of children and of pets, where pets are allowed by prior arrangement. Everyone in your party is expected to understand and follow these rules, and the lead guest accepts responsibility for them. If any guest behaves in a way that endangers others or seriously damages the property, we may ask the whole group to leave without a refund.
8. House Rules and Property Care
To keep the cottage in good condition for every guest, a few simple house rules apply. Please treat the furniture, bedding and fixtures with care, and report any damage as soon as you notice it. Please wash the dishes you use, keep the kitchen tidy and take out the rubbish on your last day. Boots and outdoor gear should be left in the mudroom, and fires must only be lit in the designated firepit.
Please do not move furniture between rooms or take cottage items home with you, and do not leave candles or flames unattended. Check out by eleven in the morning unless we have agreed a later time. Leaving the cottage the way you found it costs very little effort and means the next guests receive the same clean and welcoming home that you enjoyed. If you realise you have left something behind, contact us and we will arrange to return it, with the cost of postage charged to you.
9. Liability for Loss or Damage
Guests stay at the cottage at their own risk. You are responsible for your own belongings, valuables, vehicles and personal safety during your stay, and we recommend that you take reasonable care of your possessions. We are not responsible for any loss, theft or damage to your property while you are on the premises, including items left in shared areas or vehicles parked on the property.
If you or any member of your party causes damage to the cottage, its contents or the surrounding land, you agree to pay for the reasonable cost of repair or replacement. We will always tell you before any charge is made and give you a fair opportunity to respond. We do not hold a blanket security charge for standard bookings, but for large group bookings we may ask for a refundable deposit, which we return in full once the property has been checked after your stay.
10. Limitation of Liability
To the maximum extent permitted by law, ADAMS CANYON COTTAGE LLC shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the website or your stay at the cottage, including loss of profits, loss of data, loss of enjoyment or wasted travel costs. Our total liability to you for any claim arising from a booking or a stay is limited to the total amount you paid us for that stay.
Nothing in these terms limits any liability that cannot be limited by law, such as liability for death or personal injury caused by our negligence, or liability for fraud. This section does not affect any rights you may have as a consumer under the mandatory laws of your country or state, and where those laws give you greater protection, they will take priority over this section.
11. Disclaimers of Warranties
The website and its content are provided on an as is and as available basis, without warranties of any kind, whether express or implied. We do not warrant that the website will be accurate, complete, reliable or free from errors, and we do not warrant that it will be available at all times or compatible with your device. Information about the cottage, the trails, the rates and the facilities is provided in good faith, but conditions can change, so we encourage you to confirm important details before you travel.
Hiking in the canyon involves natural risks, including uneven ground, changing weather and wildlife, and you take part in outdoor activities at your own risk. Weather and road conditions can also change quickly in Utah, and you are responsible for planning your travel and checking local conditions before you set out. We are not liable for any injury or loss arising from outdoor activities on the trails near the cottage.
12. Indemnification
You agree to indemnify and hold harmless ADAMS CANYON COTTAGE LLC and the developer AdamsCottage from and against any claims, losses, damages, costs and expenses, including reasonable legal fees, arising out of or related to your use of the website, your booking, your stay at the cottage or your breach of these terms. This includes claims arising from the actions of members of your party.
This indemnity does not apply where the claim arises from our own negligence or unlawful conduct. If a claim is made against us as a result of your actions, we will notify you and give you the opportunity to respond before any settlement is agreed. You are responsible for ensuring that everyone in your group understands and follows these terms during the stay.
13. Third Party Links
Our website may contain links to external websites or services, such as trail information, local businesses or payment providers, that are operated by third parties. We provide these links for your convenience, but we do not control the content, practices or policies of those websites, and we are not responsible for anything you encounter there. A link to a third party website does not mean that we endorse it or its content.
When you leave our website, the privacy policy and terms of service of that third party website apply, and we encourage you to read them before you use their services. We do not accept any responsibility for the availability, accuracy or security of external websites, and any dealings you have with them are conducted at your own risk. We add and remove links only with care, and we will remove any link quickly if we are asked to do so for a lawful reason.
14. Privacy Policy and Personal Data
Your use of the website and our services is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information. The Privacy Policy is available at the Privacy Policy page on this website and forms part of these terms. By using our services you agree to the collection and use of information as described in the Privacy Policy.
When you book a stay or send us a message, you confirm that the personal information you provide is accurate and that you have the right to provide it. We use your information only for the purposes connected with your enquiry, booking and stay, and we never sell your data. If you would like to review, correct or delete the information we hold about you, please contact us at alert@adamscottage.lol, and we will assist you.
15. Intellectual Property
The content of this website, including text, graphics, the cottage scene illustration, logos and the name ADAMS COTTAGE, is owned by ADAMS CANYON COTTAGE LLC or the developer AdamsCottage and is protected by copyright and other intellectual property laws. You may view and print pages from the website for your own personal, non commercial use.
You must not reproduce, distribute, modify, publish or create derivative works from our content without our prior written permission, and you must not use our name or branding in a way that suggests endorsement or affiliation. Our name and logo may not be copied or used as trademarks without permission. If you would like to use any part of our content, please ask us first, and we will usually be glad to help.
16. Termination of Access
We may suspend or terminate your access to the website, or cancel your booking, at any time if you breach these terms, if you behave in a way that is unlawful or that puts others at risk, or if we are required to do so by law. If we terminate a booking for a breach of these terms, you may lose any deposit or payment made, and you will still be responsible for any damage you caused.
You may cancel your booking at any time in line with our cancellation policy. Sections of these terms that by their nature should survive termination, such as those relating to liability, indemnification, intellectual property and governing law, will continue to apply after your booking or your use of the website has ended.
17. Governing Law and Dispute Resolution
These terms and any dispute arising from them are governed by the laws of the State of Utah, United States, without regard to its conflict of law rules. Any dispute that cannot be resolved through good faith discussion will be submitted to the exclusive jurisdiction of the courts located in the State of Utah.
Before starting any formal proceeding, we ask that you contact us first at alert@adamscottage.lol or +18146214805, and we will work in good faith to resolve the matter quickly and fairly. Nothing in this section prevents you from exercising any rights you have as a consumer under the mandatory laws of your country or state, and the mandatory law of your place of residence will apply where it gives you greater protection.
18. Severability
If any provision of these terms is found to be unlawful, void or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions. Where a provision is found to be unenforceable in part, it will be read down to the minimum extent necessary to make it enforceable, and the rest of the provision will continue to apply.
The remaining terms will continue in full force and effect as if the unenforceable provision had never been included. We will replace any unenforceable provision with a lawful provision that, as far as possible, achieves the same purpose. This section ensures that the rest of these terms remain valid even if one part cannot be applied.
19. Entire Agreement
These terms, together with our Privacy Policy and any confirmation or other documents we provide to you in connection with a booking, constitute the entire agreement between you and ADAMS CANYON COTTAGE LLC relating to the website and your stay at the cottage. They replace all previous communications, representations and agreements, whether written or oral.
Any waiver by us of a breach of these terms is limited to that specific breach and does not constitute a general waiver. If we fail to enforce a provision on one occasion, that does not prevent us from enforcing it on another. You may not assign or transfer your rights or obligations under these terms without our prior written consent, but we may transfer our rights where required to operate the business.
20. Changes to These Terms
We may revise these terms from time to time to reflect changes in our services, the law or our practices. When we make changes, we will update the date at the top of this page, and significant changes will be brought to your attention with reasonable notice. The version of the terms in force at the time you make a booking will apply to that booking, unless we agree otherwise in writing.
By continuing to use the website after changes are posted, you accept the revised terms. We encourage you to review this page before each new booking so that you are aware of any changes that may affect you. If a change requires your consent under the law, we will ask for it before the change takes effect.
